No blame for driver in fatal Arizona pedestrian accident

A pedestrian accident in Arizona claimed the life of a Phoenix woman recently. The accident occurred at 9:45 p.m. and it appears that the 49-year-old woman did not observe safe traffic protocol. She stepped out into traffic when she should have yielded the right of way to the vehicle that struck her. Police will not charge the driver of the vehicle involved in this fatal accident.

Usually when a pedestrian accident happens, the first instinct is to look at the driver. We assume that the driver is at fault for not seeing the pedestrian, or for failing to observe other basic driving protocols that would have allowed them to see the upcoming pedestrian. Sometimes, though, it is the pedestrian who is at fault for creating a dangerous situation.

It's a reminder for both drivers and pedestrians that you need to be safe when you are out on or near the road. Pedestrians need to obey the street signals and only walk in the crosswalks, while drivers need to be aware of pedestrians at every intersection -- while also staying alert for pedestrians that may appear suddenly.

While not every pedestrian accident is the fault of driver of a vehicle, it frequently is the case. These pedestrian accidents rarely end with people suffering minor injuries. Instead, pedestrians usually suffer serious or catastrophic harm. Sometimes this changes their life forever, and in most cases it leaves them with huge medical bills. If they can establish that the driver was negligent or reckless, they could pursue legal action that would allow them to recoup some damages, thus helping them deal with their injuries and medical bills.
