Fatal wreck claims the life of Scottsdale pedestrian

A pedestrian was struck and killed in Scottsdale, Arizona last week. It is unclear if the pedestrian was in the crosswalk or not. She was in the street when a motor vehicle struck here. She was declared dead at the scene, and the driver who hit her remained there. Police do not suspect that the driver was under the influence of alcohol, nor do they believe the driver was speeding.

Little else is known at this time about the accident. It is possible that the driver of the vehicle was negligent in some other way -- just as it is likely that the driver did not do anything wrong to trigger the accident.

However, this is a good time to remind people that in many pedestrian accident cases, there are circumstances involved that make the driver at fault. These circumstances may not necessarily warrant criminal charges or a criminal case, but they can certainly be more than enough to pursue civil justice against the driver. If the pedestrian is killed, their family or loved ones could pursue a wrongful death lawsuit against the driver, which is exactly what could happen in this case.

A wrongful death lawsuit can be a complex matter, and the people who are filing the lawsuit need to provide substantial evidence to prove that their loved one was killed as a result of another's negligence. It is also important to realize that most lawsuits of this nature are settled or resolved out of court.
