Why would you want to legally separate from your spouse?
Divorce is a permanent solution to a critical problem. If you have an unhappy and unfulfilling marriage, then getting a divorce is the solution to that. However, when you get a divorce, it legally ends the marriage — and for some couples, that is too quick or too permanent of a move at the moment they decide something needs to be done about their marriage.
This is where legal separation can be especially helpful. Legal separation means that you and your spouse separate and live apart for a time — but you are still legally married. The separation can include many of the things that a divorce includes, such as child custody, child support, spousal support and property division. During the separation, you can decide if living on your own and confronting life’s challenges without your spouse feels right. If it does, you can transition your separation into a permanent divorce.
Another reason that separation can be a good idea is if there are religious or insurance complications tied to your divorce. If you have religious concerns, or if filing for divorce would cause insurance complications, then separation can be the perfect middle ground for your situation.
